US District Judge Richard Seeborg threw out a class action lawsuit alleging Arizona Iced Tea’s classification of its beverages as all natural was misleading, according to Juan Carlos Rodriguez of LexisNexis Law360. Seeborg decertified the class of consumers who brought the suit and called the evidence insufficient. “Defendants have established that they are entitled to summary judgment by showing that plaintiffs have not introduced any evidence showing that high fructose corn syrup (HFCS) or citric acid are artificial, nor have they produced any evidence from which damages may be assessed,” said the judge. Arizona Iced Tea produced an expert witness to testify that HFCS is natural as defined by FDA’s natural policy.
